WILLS
A will is a legal document which provides for the transfer of property upon
one's death.The purpose of a will is to bequeth your property to the
person or persons you want your estate to be left to. Without a will your
property will be distributed to those related to you according to shares
under state law. Having a will allows the property to be distributed
according to your wishes. If not properly drafted a will may not be
recognized by the court.
TRUSTS
A trust is a legal relationship whereby one individual (the “settlor”)
transfers his or her assets (the “trust fund”) to another individual or
company (the “trustee”) who holds and manages these assets for the
benefit of others (the “beneficiaries”) named by the settlor. The trustees
are bound by the terms of the trust deed.
A trust can be established during your lifetime (“inter vivos trust”) or upon
your death under the terms of your will (“testamentary trust”).
Trusts have different characteristics depending on the provisions
included in a trust deed. For example, a trust may be revocable or
irrevocable; discretionary or specific. To allow for maximum flexibility,
most people establish a discretionary trust, which gives the trustee
discretionary power to react swiftly to changed circumstances.
POWER OF ATTORNEY
A legal document that authorizes another person to act on one's behalf.
A power of attorney can grant complete authority or can be limited to
certain acts and/or certain periods of time.
HEALTH CARE PROXY
A health care proxy is a simple legal document that designates a trusted
relative or friend to make health care decisions for you if, because of an
illness or accident, you're incapable of making or communicating them
yourself.
LIVING Will
A document in which a person specifies the kind of life-saving and life-
sustaining care and treatment he or she does or does not wish to receive
in the event the person becomes both incapacitated and terminally ill.
Many states have their own titles for a living will document such as
"Directive to Physicians," "Declaration Concerning Health care," etc.
Massachusetts law considers the document good evidence of patient
wishes; however, it is not legally binding in Massachusetts
